A Surviving Member Certificate also known as SMC Certificate or Legal Heir Certificate is a legal document issued by the Office of the Executive Magistrate in Delhi. This certificate mentions the names of surviving members of a family after demise of one of its members. In other words, the SMC Certificate lists down the immediate family members who are alive after the death of a particular individual.
The main purpose of the SMC Certificate is to distribute assets, claim insurance, or look after other financial and legal issues which may arise after death of particular individual. The certificate is a proof and an official record, ensuring that the rights of the surviving members are protected and that they can legally get what is due to them.

The SMC Certificate may be required for following purposes :

1. First of customer has to provide required documents.
2. Documents: (A) Aadhaar and pan card with 1-1 passport size photo of Surviving Members and deceased (B) Death certificate and ID proof of deceased.

4. Clients can submit documents at office also and pay fee in cash against receipt. Timings are 10:00 AM to 6:00 PM. Monday to Saturday. Address is given at the bottom of this page.
5. File will be ready in 1 or 2 working days which includes all required affidavits, forms, hard copy of all required documents with photos. Clients don't have to move out of their house for anything for preparation of file.
6. Then the file will be sent to you for signatures and appointment for presentation of file will be arranged.
7. File has to be submitted at District Magistrate office of your area by the client which normally takes 60-90 minutes. You may avail our service for file submission at extra cost.

9. 9.As per government guidelines the surviving members certificate also known as legal heir Certificate is uploaded online within 14 days from the date of submission of file.
10. Applicant should have address proof of Delhi. Deceased or other surviving members can be from anywhere in world.
11. Place of death of deceased is also irrelevant. Again repeated for sake of clarity that only applicant should have address proof of Delhi.

Surviving Member Certificate or legal Heir Certificate is legally admissible documents in all department for transfer of movable and immovable properties of deceased.

Most of the banks accept this certificate and normally release amount lying in the accounts of deceased.
This certificate may also be accepted as proof in Government offices to claim family pension, provident fund, gratuity etc.
10. SMC Certificate may also help in transfer of property of deceased to his or her legal heirs. It also helps in execution of relinquishment deed among surviving members in case deceased died without making a will
11. Banks and Government departments treat SMC Certificate as proof because it is issued by Delhi Government.
12. This certificate is accepted in most of Indian states.
13. The certificate is uploaded by Delhi Government on its website within 14 days from the date of submission of file.
14. Customer may apply for Surviving Member Certificate on edistrict.delhigovt.nic.in which is official website of Delhi Government.
15. You can also apply offline at office of Sub-Divisional Magistrate of your area but certificate will be issued online only.
16. There is no government fee to get this certificate as the same is provided by Delhi Government without any fee.
17. Parents, children, spouse, grandparents, grandchildren, daughter-in-law are eligible to get this certificate.
18. Sometimes cases are rejected by authority due to some issues such as incorrect uploading of documents, incorrect affidavits, rejection of verification, death certificate verification issues and many others.
19. Surviving Member Certificate mentions name and address of deceased with death certificate number.
20. SMC Certificate bears the name of surviving members and their relationship with deceased but their address is not mentioned on certificate.

27. Some departments insist on succession certificate especially when the estate is large.
